Unmarried Partner Visa (De Facto Spouse)

This visa allows a person to apply for a visa to remain in the United Kingdom as an unmarried partner or same sex with a partner that is present and settled or has permanent residence in the United Kingdom.

Requirements

  • You must have permanently been living together in a subsisting relationship as partner for a period of 2 years or more if applying from the United Kingdom
  • You must be in a relationship which subsisting 
  • All other marriage relationships to the partners must have broken down
  • You must intend to live together permanently at the same address
  • The parties must have sufficient funds and adequate accommodation without recourse to public funds

Visa Period

The period granted under unmarried partner visas is 2 years, however a further extension can be made after that period.

A visa national can apply for Indefinite Leave or Permanent Residence to remain in the United Kingdom provided that the unmarried partners remain living together in a relationship after a period of 2 years.
