Marriage Visa

A married person or Civil Partner to a British Citizen or someone granted Indefinite Leave to Remain or someone with settlement status in the United Kingdom can apply for a marriage visa from the United Kingdom or from a British Diplomatic post overseas to join and live with their spouse or civil partner in the United Kingdom under the marriage visa.

Visa Period

The initial period given under the marriage visa is granted for 2 years, provided that the couples marriage and relationship remains subsisting over a period of 2 years with evidence that the person is still a spouse and have been living permanently together for that duration, the person will be eligible to apply for Indefinite Leave to Remain or Permanent Residence in the United Kingdom.

A married person or Civil Partner to a someone granted Indefinite Leave or  someone with settlement status in the United Kingdom can also be granted indefinite leave or settlement status with leave to enter the United Kingdom provided that the person has been married or been a Civil Partner for a period of 4 years and been living outside the United Kingdom with their spouse or partner before applying to come to the United Kingdom on the same occasion.

Visa Requirement

  • the applicant is legally married or is a registered civil partner of a settled spouse or partner in the UK
  • the parties to the marriage have met; and
  • each of the parties intends to live permanently with the other as his or her spouse or partner and the marriage is subsisting; and
  • there will be adequate accommodation for the parties and any dependants without recourse to public funds in accommodation which they own or occupy exclusively; and
  • the parties will be able to maintain themselves and any dependants adequately without recourse to public funds
  • the applicant in the United Kingdom is 16 years of age or over and the spouse or partner settled n the UK must is 18 years of age or over

A person who wishes to get married or register their partnership in the United Kingdom whether to a person settled or not settled must now seek a Certificate of Approval of marriage in the UK before the person is allowed to get married in the UK.

Both parties to the marriage or civil registry must have more than 6 months leave/visa granted in the United Kingdom in order that permission can be granted under Certificate of Approval to marry or register.

People who have more than one spouse living outside the United Kingdom will only be allowed to have one of the spouses’  to join them under marriage visa to the United Kingdom.
