Indefinite Leave to Remain (ILR)
Indefinite Leave to Remain in the United Kingdom gives a person a right to a settlement status to live and work in the United Kingdom without restrictions to time limits or conditions to remain in the UK, sometimes known us full residence, ILR or Residence Permit.
Thus, a person granted Indefinite Leave to Remain can remain in the United Kingdom for an indefinite period subject that the person intends to remain present and settled in the United Kingdom. However should the person remain absent from the UK for a continuous period over 2 years, this may be deemed that the person is any longer a settled person, and their settlement status may be revoked.
A person will be eligible to apply for Indefinite Leave to Remain in the United Kingdom once the person has completed a number of years prescribed under the immigration visa category the fall in the United Kingdom from the following:
- Period of 2 years under Marriage or Unmarried Partners visa
- Period of 5 year as a Work Permit holder
- Period of 5 years as HSMP visa holder
- Period of 5 year as an Ancestry visa holder
- Period of 10 years continuously legal stay in the UK under various visa categories.
- Period of 14 years stay in the UK legally/non legally
- Period of 5 years in stay under investors visa
- Period of 5 years under a Writer, Composer, or Artist visa
- Period of 5 years stay as retired person of independent means
- Period of 5 years for EEA National / Non EEA family members who have applied for residence permit
Dependants of person(s) who have been granted dependency to the principal visa holder under most of the above visa categories will also be eligible to apply also for Indefinite Leave to Remain in the United Kingdom.
