Change of employment under Work Permits

An employer who wishes to employ a person already under work permit arrangements in the UK must apply for a change of employment work permit, and employee can not transfer automatically their work permit to the new employer before the new employer is given permission to employ them under a new work permit.

An employer can apply for a work permit under change of employment provided that the job role and conditions being offered to the employee remains the same as under the previous employment.

Further the employee is usually given a reasonable period within 28 days after leaving previous employment to secure further employment under change of employment work permit scheme, otherwise the employer will be required to make a fresh work permit application and/or seek leave to enter the United Kingdom to commence the new employment.

Should the job role and conditions under the pervious work permit employment be different to that under the new employer’s work conditions then the employer will need to advertise the post for at least a period of 1 month before the employer can apply for a work permit to recruit the new employee, should he not find a suitable resident worker to fill in the post.

Please note that the employee has to further secure leave to remain under change of employment to commence employment for the new employer, and the employee cannot transfer their pervious leave to remain granted for the pervious employment to commence employment for a new employer and an application for further leave must be made.
