British naturalisation
A foreign national who has been granted Indefinite Leave to Remain the United Kingdom and has remained in the UK for a period 3 years under marriage visa or 5 years under other visa categories or legally will be eligible to apply for British Naturalization with the right to become a British Citizen and can apply for a British passport.
A person from outside the UK who is born before 1 January 1983 to a British mother will also be eligible to apply for British naturalisation and a person born to a British father outside the UK will be entitled to British citizenship.
A person who has held Right of Abode for a period of five years and over may either register or naturalise.
Requirements
A person who is 18 years and over and has either remained in the UK for a period of 3 years or 5 years granted with indefinite leave for 12 months and over will be eligible for British Naturalization from the following: -
British naturalization under marriage after being granted Indefinite Leave
A person who is eligible to apply for British Naturalization after been granted Indefinite Leave based on 3 year under marriage must not have spent more than 270 days in the last 3 years, and no more than 90 days in the last 12 months before applying for British Naturalization.
British naturalization under other visa categories or post grant of asylum or discretionary leave after being granted Indefinite Leave
A person who is eligible to apply for British Naturalization after been granted Indefinite Leave based on 5 year under other visa categoriesor post grant of asylum or discretionary leave must not have spent more than 450 days in the last 5 years, and no more than 90 days in the last 12 months before applying for British Naturalization.
Furthermore, to be eligible for British Naturalization a person must also meet the following: -
- Have a continued intention to be settled in the UK,
- be of sound mind have a continued intention to be settled in the UK,
- demonstrate knowledge to speak an adequate level of English or Welsh or Gaelic
- demonstrate knowledge of life in the UK
- Be of good character.
